LOS ANGELES ? Shares of BlackBerry maker Research in Motion Ltd. surged Tuesday amid speculation that billionaire investor Carl Icahn has taken a stake in the company.

Rumors that the activist investor was buying into the troubled smartphone maker caused shares to spike around 10:22 a.m. Eastern time.

Icahn is already set to cash in an 11.4 percent stake worth more than $1.3 billion in Motorola Mobility Holdings Inc., after Google Inc. declared it was buying the cellphone maker, mainly for its trove of cellphone patents.

The market is hoping that Research in Motion is next in line to be acquired.

Brigantine Advisors analyst Kevin Dede said he had heard rumors of Icahn taking a stake but couldn't confirm them.

Icahn did not respond to a request for comment and a spokeswoman for Research in Motion declined to comment.

Research in Motion shares rose 97 cents, or 4.5 percent, to close at $22.65 on Tuesday, although they had been up as much as 8 percent earlier in the day.

Shares have been on an almost steady decline since hitting a recent peak of $70.54 in February and cresting slightly at $33.54 in early September.

Research in Motion is fighting to stay relevant amid two dominant mobile operating systems, iOS created by Apple Inc., and Google's Android, which it shares freely with handset makers. The company, based in Waterloo, Ontario, had dominated the corporate smartphone market but regular consumers have been drawn to phones with big touchscreens like the iPhone and Samsung Galaxy, which runs on the Android platform.

Earlier this month, Research in Motion shares plummeted nearly a fifth in one day, after the company reported a sharp decline in net income and missed analysts' estimates. It also sold fewer of its Playbook tablet computers than expected.

Research in Motion's prospects seem to be fading, as its competitors are shoring up their businesses. Google bought Motorola for its huge array of more than 17,000 patents related to cellphone technology to defend its Android system against a litany of lawsuits. Dede said Research in Motion does not have as strong a patent portfolio and therefore is not as attractive an acquisition.

Its latest phones running on the BlackBerry 7 operating system have had a lukewarm reception and Dede said he has doubts about whether its QNX tablet software platform will gain traction.

"I'm not saying (Icahn) made a wrong (decision) here. I just don't agree with it," Dede said.

The analyst maintained his "sell" rating on the shares with a $20 price target.

LOS ANGELES (AP) ? Jurors in the upcoming trial of Michael Jackson's doctor won't see a recording of a press conference by the singer promoting his final concerts, a judge ruled Monday.

Defense attorneys for Dr. Conrad Murray had wanted to show the footage, claiming it showed Jackson wasn't healthy and had only committed to 10 shows. By the time of his death, the singer had been committed to 50 shows at London's O2 arena.

Superior Court Judge Michael Pastor ruled the March 2009 press conference wasn't relevant to the involuntary manslaughter case against Murray, which will focus on the pop superstar's final weeks and hours.

Defense attorney Nareg Gourjian said that according to promoters of the shows, Jackson's press conference was delayed 90 minutes because the singer was passed out and appeared to be "hung over."

"We believe that it's readily apparent from watching the video that Mr. Jackson was under the influence," Gourjian said.

Pastor said showing the footage would be prejudicial and the defense's request included speculation that should not be shown to jurors.

The judge also blocked prosecutors from mentioning efforts by investigators to speak to Murray after his initial interview with police days after Jackson's June 2009 death.

The rulings were some of the final bits of housekeeping before opening statements, set for Tuesday.

Murray has pleaded not guilty. He could face up to four years in prison if convicted and the loss of his medical license.

Authorities contend the Houston-based cardiologist gave Jackson a lethal dose of the anesthetic propofol and other sedatives. Murray first disclosed he had been giving Jackson the anesthetic in the bedroom of the singer's rented mansion during his interview with police.

Murray's lead defense attorney Ed Chernoff disputed whether authorities left messages seeking another interview with the physician. Ultimately, Pastor determined attempts to contact Murray through his counsel should not be brought up during the trial.

And those people are right, for the most part, but there's no reason to dig out the pitchforks and torches. The Metro UI isn't going to "ruin" your Windows 8 experience. It's just a new way of interacting with the OS, and if you'd rather never touch it with your mouse, you don't have to.

The Metro Interface Is Designed for Touch...

In Microsoft's keynote, they mentioned that the computing world is moving toward touch interfaces, and that may be true. They said that the Metro UI was designed to work with a mouse and a keyboard, but that it was so good that you'd wish you could touch your screen, even when on a regular desktop monitor. That should have been their first clue that it isn't a viable Start menu replacement.

Every time I boot into Windows 8, I want to reach over and touch my screen, simply because it's so awkward to use with a mouse. It's hard to even figure out how it works with a mouse. Should I click on the screen and drag it to swipe over? How the heck do I pinch to zoom? Even scrolling with the scroll wheel is awkward, since you're scrolling the mouse wheel up up and down to move the screen side to side. Not to mention that to click on an app, you have to move your mouse across the entire screen and actually do more scrolling than you had to do with the Windows 7 Start menu. Really, it's just inefficient, awkward, and frustrating, just like everyone's expecting it to be.

...But That Doesn't Really Matter...

However, once you bypass the Metro UI at startup and get into the traditional desktop (which you can do with a quick stroke of Win+M), none of that matters anymore. Sure, your Start menu's gone, but chances are most of you are using something like Executor, Launchy, or one of the many other great app launchers out there to start programs (and if you aren't, you should). Seriously ask yourself: Do you really use the Start menu all that much anymore, except maybe to shut down? Probably not. And if you do, you can easily replace it with one of the above launchers.

And, if you're addicted to the old Start menu search, all you need to do is re-learn the keyboard shortcut for search?now Win+ to search through files on your machine. Once you open them up, they'll just open up in their default app on the desktop. No need for the Start menu at all.

...And Metro's Still Good for a Few Things

The Metro UI may not be great as a Start menu, but I've found it still has a few neat applications on the desktop. Metro's informative tiles are pretty nice for keeping you up on emails, new tweets, the weather, upcoming calendar events, and so on?it actually makes a cool screensaver, of sorts. If you're getting up from your desk but staying nearby, you can just pop up the Metro UI and be able to see all that information from afar. Then, when you come back, just hit the Windows button and you're magically back on the desktop.

If you have dual monitors, you're also in a pretty cool position where Windows will automatically load Metro on one monitor and your desktop on the other monitor. You can always throw Metro up on one side, with all its informative tiles, when you aren't actively using both monitors (after all, why use a Metro-styled Rainmeter theme when you could just use Metro itself?).

Metro isn't without it's little annoyances, of course, and yes, I kind of wish Microsoft had more sanctioned options for turning it off. SAN FRANCISCO (AP) ? Tony Romo felt sick to his stomach. It hurt to breathe, let alone bark out the cadence in a hostile road stadium.

Playing with the throbbing pain from a fractured rib, Romo rallied America's Team just as he promised he would.

In a week when Romo vowed to play his best game, he delivered a gutsy comeback that looked so unlikely when he briefly came out from halftime and then returned to the locker room.

Moments after the Cowboys (1-1) announced the quarterback was done for the day, there came No. 9 ready to take charge of the huddle once again.

Romo hit Jesse Holley on a 77-yard completion on the Cowboys' first play of overtime that set up Dan Bailey's winning 19-yard field goal 2:53 into the overtime, and Dallas pulled off an improbable 27-24 victory over the San Francisco 49ers on Sunday.

In one frantic span, Romo emphatically left his mark on the storied Cowboys-49ers rivalry that dates back decades to all those epic matchups in the NFC title game that regularly set up Super Bowl victories by the winner.

"It's got to be one of those things that will follow him through his career. I know what it was here in the locker room at halftime. I know what he had to do to get back on the field," Cowboys owner Jerry Jones said.

"I know what he had to do before (painkillers) took hold to relieve him from his pain. But, boy, did he come back. That was inspirational."

Romo emerged from the locker room after the second-half kickoff and walked briefly into the huddle as Jon Kitna returned to the sideline, then Romo immediately came off under doctor's orders and headed back to the locker room.

Back on the sideline late in the third quarter, Romo tapped Jason Garrett on the shoulder and told the coach to put him back in the game.

"Eventually, what was convincing was, 'At some point I'm going to play with this thing, so why not now?'" Garrett said, quoting Romo. "It's about a quarterback but it's really about a football player and a competitor. And Tony is that. One of the best competitors I've ever been around."

This was an exact reverse of what happened a week earlier: a 27-24 road loss to the Jets after Dallas blew a late 14-point lead and watched New York kick the winning field goal. Romo's late interception contributed to that Week 1 collapse. Going on a few hours of sleep, he was back to work early Monday morning preparing for the 49ers.

Bailey kicked a tying 48-yard field goal Sunday as time expired in regulation after missing an early 21-yard attempt. That delighted the large contingent ? close to one-third ? of Cowboys fans in Candlestick Park.

Romo completed five of six passes on the tying drive, connecting on consecutive throws to Holley before finding him again in OT.

"Ribs are tough," Romo said. "It's just hard to breathe, and talk really. You have to talk loud, especially on the road."

Romo wasn't the only one playing hurt, either. Running back Felix Jones separated his shoulder early in the game, Jerry Jones said.

Miles Austin made three touchdown receptions among his nine catches for 143 yards, leaping over a defender and diving into the end zone to pull Dallas within 24-21 with 6:55 to play. Austin later hurt his hamstring.

Jones won't need to defend Romo after this one. He grimaced and limped. He needed help from a lineman to stand up as the vicious hits kept coming.

Romo completed 20 of 33 passes for 345 yards and Kitna found Austin for a 5-yard TD, but also threw two interceptions during his brief appearance. As Romo's teammates celebrated, cheered and hugged, he slowly made his way to midfield for postgame handshakes.

Romo returned for the last series of the third quarter, the final 15 minutes and OT. He didn't give Garrett much chance to say no.

"I just told him I was good to go. I think he asked some of the guys," Romo said. "I didn't give him too much of a chance. I just ran on the field."

The 49ers (1-1) were trying to move to 2-0 under new coach Jim Harbaugh after a 33-17 victory over defending NFC West champion Seattle last week.

Alex Smith threw for 179 yards and two touchdowns, including a 29-yard strike to Delanie Walker in the third quarter. Smith found himself in the familiar predicament of getting hit. He was sacked six times as San Francisco's offensive line often failed to protect him or give him ample time in the pocket to be effective.

Frank Gore ran for a 1-yard score and Kyle Williams had a 12-yard touchdown catch as San Francisco went ahead 14-0.

Dallas had a final chance in regulation, getting the ball back with 4:03 to play starting from its own 26.

Romo, in the shotgun as he'd been most of the day, delivered on third-and-6 from the 43 with a 7-yard completion to Austin. They connected on another 7-yard gain the next play.

After Jones this week called Romo's performance against the Jets "outstanding," Romo made all the right calls in crunch time.

He played through multiple hits in the first half, when he threw a late 53-yard touchdown pass to Austin to bring Dallas within 14-7. The QB came up slowly after being clobbered on a blindside cornerback blitz by Carlos Rogers as he was throwing in the second quarter.

Romo looked to be headed for another tough day.

The Cowboys came up short on a 76-yard drive over the opening 7? minutes after Bailey missed wide right on his 21-yard field goal attempt. Then, it was three straight three-and-outs.

When it mattered, Romo came through.

"He understands that all eyes are on him," said safety Donte Whitner, beat on the deep throw in OT.

"They expect him to lead them to the playoffs and ultimately a championship. For a guy like that, after the things that happened last week, you expected him to come back into the football game."

Notes: It was the first overtime game of the season. ... The 49ers were outgained in total yards 472-206. ... Dallas' DeMarcus Ware and Jason Hatcher each had two sacks. ... San Francisco's Braylon Edwards limped off with a right knee injury after making a 21-yard catch in the first quarter. Harbaugh had no update afterward.

A senior exec told The Korea Times it plans to file a request to block the sale of the upcoming iOS handset in its Korean homeland the moment the device is announced. According to the Times, the anonymous exec said it would leverage its wireless technology patents and demand that Apple either remove the telecommunications features -- turning the iPhone into an iPod touch -- or simply be banished from the Korean market. The knock-down-drag-out war between the two companies has only seemed to escalate in recent weeks, as Sammy has taken a much more combative and offensive approach. We can only hope the two get tired of divvying up the globe and declare a draw in this game of patent Risk.
